HOLMES MAN SENTENCED AFTER FAILURE TO APPEAR

CARMEL, NEW YORK – August 4, 2025 – Putnam County District Attorney Robert Tendy announced today that Anner Osorio-Sarseno, also known as Willian Suniga, 34, of Holmes, was sentenced in absentia on July 30, 2025, by the Honorable Judge Anthony Molé, following his guilty pleas to Driving While Intoxicated and Aggravated Driving While Intoxicated, both classified as D felonies.

On August 19, 2023, a member of the New York State Police observed a vehicle traveling on State Route 312 in the Town of Southeast unable to maintain its line. Upon initiating a vehicle and traffic stop, the vehicle parked in the middle of a three-lane intersection. The driver, who identified himself as Willian Suniga, was observed to have bloodshot, watery eyes and an odor of an alcoholic beverage coming from his breath.  Suniga admitted to consuming 5 Modelo beers prior to driving home. After failing Standardized Field Sobriety Tests, Suniga was placed under arrest and provided a breath sample that determined his blood alcohol content to be .18%. It was later determined after Suniga was fingerprinted, that his name is Anner Osorio-Sarseno.

On October 12, 2024, a member of the New York State Police observed a vehicle speeding on Interstate 84 in the Town of Kent. The driver, identified as Anner Osorio-Sarseno, displayed bloodshot, watery eyes and had an odor of an alcoholic beverage. A DWI investigation determined Osorio-Sarseno to be intoxicated. Following his arrest, an almost empty can of Bud Light Chelada was found wrapped in a sweatshirt on the passenger side floor of the vehicle. Osorio-Sarseno provided a breath sample which determined his blood alcohol content to be .16%.

Osorio-Sarseno was convicted on two prior occasions of driving while intoxicated, a crime that is not bail eligible under New York State’s bail reform.

On May 7, 2025, Osorio-Sarseno pleaded guilty with an agreed-upon sentence of 1 to 3 years state prison. On the day of sentence, Osoario-Sarseno failed to appear, and a second date was sentencing was scheduled by the court.  After his second failure to appear, the District Attorney’s Office petitioned the Court to proceed with sentencing in his absence and requested an enhanced sentence of 2 to 6 years on each count, to be served consecutively.

The Court granted the People’s motion and Osorio-Sarseno was sentenced to a total of 4 to 12 years in state prison.

District Attorney Tendy said, “It’s bad enough this defendant was drinking and driving—again. Then he didn’t show up for sentence, so now there’s a dangerous driver out there. He’ll get picked up, hopefully before he hurts someone, and he’s going to get a lot more jail time than originally agreed upon. He deserves that.”

The case was prosecuted by Assistant District Attorney Mackenzie Ferguson.
